Madrid China provisional refusal — 15-day response tracker

When CNIPA rejects part (or all) of your Madrid designation in China, you have only 15 days from the date you actually received the WIPO notification to file a review. Miss it and the China designation is gone for good. Nothing leaves your browser.

Do not use the WIPO Geneva mailing date — Chinese law counts from receipt by the applicant or its Chinese agent. Use the date stamped on the forwarded envelope / email from your Chinese associate.

Critical rules for a Madrid China-phase refusal:
  • The review must be filed by a CNIPA-recorded Chinese agent, in Chinese — your home-country attorney cannot file it directly.
  • The 15 days are calendar days; if the last day falls on a Chinese public holiday, it rolls to the next working day (confirm the holiday calendar with your agent).
  • If you miss the deadline, the CNIPA decision becomes final and your entire China designation under this international registration is cancelled — there is no reinstatement (unlike a domestic national filing, where a late grace exists for renewals but not for refusal review).
  • The review may be filed against the refusal only; you cannot add new goods/services at this stage.
