Trademark Watch & Opposition Setup Checklist
In China, conflicting marks are open to opposition for only
3 months
after preliminary publication. Set up a watch so you never miss the window.
1. Define what to watch
Your exact brand name (word mark)
Phonetic / transliteration variants (pinyin, Chinese characters)
Your logo / stylized mark
Your key Nice classes (product + Class 35)
2. Set the monitoring
Subscribe to CNIPA publication gazette alerts for your classes
Review new publications at least monthly (3-month window is short)
Keep prior-use evidence ready (date, channel, sales)
3. When a conflict appears
Confirm it falls within the 3-month opposition window
Gather your rights: your registration + prior-use proof + confusion arguments
File the opposition via a CNIPA-recorded agent before the window closes
After the 3-month window, you must use invalidation instead (longer, costlier). A watch service is strongly recommended for active brands.
