China cancels a registered mark if it has not been used for 3 consecutive years (non-use cancellation / 撤三), and the 2027 Trademark Law adds a 5-year use declaration. Tick the evidence you already hold to score your file and see the strongest items you are missing.

The three things every item must show
The trademark — the mark as registered, used in an identical or visually indistinguishable form (a materially different logo may not count).
The registered goods/services — use on the exact items (or closely related items) listed in the registration; use on other goods does not save the mark.
Real, open commercial use within the relevant period — dated, and falling inside the three years before a cancellation filing. Single, isolated or internal-only use is usually insufficient.

General guidance based on CNIPA non-use cancellation practice and the Trademark Law as revised in 2026 (in force 1 January 2027). Implementing rules for the 5-year declaration are being issued by CNIPA — confirm the current formalities before filing. This is not legal advice.
